Domestic Abuse

You can talk to us in complete confidence. Valerie Henley is an accredited specialist with Resolution in Domestic Abuse matters and regularly prepares Injunction Applications and represents victims of domestic abuse in the Courts.

We advise on

  • Injunctions under the Family Law Act 1996.
    • Occupation Injunctions (allowing you to remain in your home and/or exclude your Opponent from it)
    • Non-Molestation Injunctions, this restrains someone from using or threatening violence to a person or child or from molesting them and/or instructing, encouraging or in any way suggesting that any other person uses or threatens violence.
  • Protection from Harassment Act 1997 – Harassment is when someone behaves in a way which makes you feel distressed, humiliated or threatened and can be by someone other than your partner, ex-partner or family member such as a neighbour or people from the local area.

The Act says you must have experienced at least 2 incidents of harassment by the same person or group of people for it to be harassment.

  • Controlling or coercive domestic abuse under section 76 of the Serious Crime Act 2015 – in December 2015 controlling or coercive abuse (which is designed as causing someone to fear that violence will be used against them on at least 2 occasions or causes serious alarm or distress which has a substantial effect on usual day to day activities) became a crime punishable by up to 5 years in prison.
