Are you eligible to make a claim?
You may be eligible to make a claim if:
- You have been the victim of a crime of violence in England, Scotland, or Wales.
- You have suffered injury as a result of a violent crime.
- The crime has been reported to the police.
Is there a time limit for making a CICA Claim?
Any claim must be made within 2 years of the date of the incident if you were over the age of 18 at the time of the incident. However, if there are exceptional circumstances that have made it difficult for you to submit your claim, you may be able to apply for an extension.
If you were a child at the time of the incident, so long as the incident was reported to the police prior to the child’s 18thbirthday, you will have 2 years from the date of the child’s 18th birthday to submit a claim.
How are awards decided?
There are fixed tariffs for each injury you may have. If you have two or more injuries that would qualify for an award you would receive 100% of the tariff for the most serious injury, You would receive 30% of the full tariff for the second injury and 15% of the tariff for the injury with the third highest vale.
You may also be able to make a claim for loss of earnings if you were unable to work as a result of your injuries.
Do I need a solicitor to make a CICA Claim?
You do not need a solicitor to make a Criminal Injuries Compensation Claim, however it has recently been reported that represented Claimants receive up to six times more compensation than unrepresented claimants.
