Failing to take into consideration cavaets like the Dilapidations clause can result in significant expenses not calculated for when moving on to newer premises. To stress the importance of this, here is a quote from TPG who wrote in our Autumn Newsletter:
“The subject of dilapidations at the end of a lease is not the most riveting subject and would rarely get to a board room agenda during a lease term but if you received a claim from your landlord for more than £350,000 three months before your lease ends I am sure it would have your attention. This recently occurred and TPG Consulting were asked to assist to deal with the claim. The law of dilapidations is often seen as a complex subject for Building Surveyors and Lawyers to deal with but with the rise of shorter term leases and the increase in the number of dilapidation claims from landlords, it is no wonder that tenants should be well informed of their potential end of lease dilapidations liability”.
